General terms and conditions

§ 1 Scope

These terms apply to all sourcing and import services of Black Forest Handels GmbH towards businesses and consumers.

§ 2 Scope of services

We broker and support the purchase of goods from manufacturers in China, including supplier search, price negotiation, quality control and the organisation of transport and customs clearance. In doing so we act as an agent on behalf of the customer.

§ 3 Remuneration

Our remuneration consists of a fixed commission on the goods value of the respective order. The amount of the commission is communicated to the customer in advance depending on product and inquiry and is stated in the individual quotation. Customs duty, import VAT and freight costs are charged separately.

§ 4 Payment terms

Payment terms, in particular deposit and balance, are set individually for each order in the quotation.

§ 5 Samples and quality control

Where samples are agreed, the series order is placed only after approval by the customer. Quality control is carried out against criteria jointly agreed in advance.

§ 6 Liability

We are liable without limitation for intent and gross negligence. For slight negligence we are liable only for breach of essential contractual obligations and limited to the typical, foreseeable damage.

§ 7 Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. Details are provided with the order confirmation.

§ 8 Final provisions

German law applies. Where legally permissible, the place of jurisdiction for disputes with businesses is Nagold.
